Recently, CJI NV Ramana meet with the Law Minister of the United Arab Emirates and had a discussion regarding the pending extradition orders and consular access to Indians in UAE prisons
Extraditions means bringing back someone who ran away from the one country to another country after committing a crime. Basically, Its a delivery of criminals to their nation. In India, there is a legislation made on the extraditions of the criminals that is Indian Extradition Act, 1962. India has signed the extradition treaty with 43 countries and extradition agreements with 11 countries.
The extradition is a process towards the suspension of crime. Normally a person cannot be punished or prosecuted in a state where he has filed away because of lack of jurisdiction or because of some technical rules of criminal law. Criminal are therefore extradited so that their crime may not punished.
The criminals are surrender as it suggest the interest of the territorial state. The extradition acts as a warning to the criminals that they cannot escape punished by fleeing to another state. The extradition has its deterrent effect also.
The extradition is done because it is a step towards the achievement of international co-operation in solving the international problems of social character.
It plays an important role in eliminating crime if it works effectively through international co-operations.
