INTRODUCTION :- In a literal sense patent is the monopoly over a new things . Patent is provided for the invention . If a person do any invention then he or she got a patent rights on that invention. In india patent is governed by the Patent Act 1970 .
Subject matter of Patent :-. There are something which must be to getting a patent rights . 1.) Novality :-. For patent there must be new product and process . There should be new invention . 2. ). Non Oviousness :-. The invention must be non obvious . The invention should not be common . 3. ). Inventive Steps :-. There must be inventive Steps , there must be any technical advancement in the invention .
4.). Industrial Application :-. There must be industrial Application of the invention . Invention must be useful .
5.). And invention not declared non patentable by any provision of Patent Act 1970 .
Rights of Patentee :-. A person who do a invention then they got a right on that invention . Section 70 of Patent Act 1970 tells about the rights of the Patentee . A person who do a invention then they got a right , right to use , right to license , right to dealing etc , right to assign etc.
Infringement of Patent :-. Infringement means breach of the rights . When the right of Patentee which are given under section 70 of Patent Act 1970 infringed by another person is called infringement of Patent . But there are some exceptions of these which are given under section 80 and section 107 and 107 A of Patent Act 1970 .
Remedies :-. If these rights infringed then there are available some remedies for this. There are some remedies like injunction ( stay ) , compensation , account of profits , and administrative remedies etc. Can be claimed by the plaintiff .
I have always been against Glorifying Over Work and therefore, in the year 2021, I have decided to launch this campaign “Balancing Life”and talk about this wrong practice, that we have been following since last few years. I will be talking to and interviewing around 1 lakh people in the coming 2021 and publish their interview regarding their opinion on glamourising Over Work.
