WHO IS A CONSUMER UNDER CONSUMER PROTECTION ACT,2019

Earlier there was the consumer protection act,1986 which didn’t satisfy the latest versions of the doing business in the market. So the parliament had passed a bill on 6th august 2019 upon which the president gave his assent on 9th august 2019. The object of the consumer protection act is to protect the interest of the consumer. The aim to enact the new act for consumer protection act was to establish the new authority under which a consumer can reach out if he has any issue in regards to goods and services mentioned in the CPA. The new act has given powers to some authorities, the provision of mediation has been introduced, with regards to e-commerce rules has been framed under this act,

Who is a consumer under the consumer protection act 2019 ?

A consumer is defined under section 2 clause 7 of the consumer protection act 2019. This act was passed by the president on 9th August 2019.

As per the act, any person who is consuming goods and services for self-consumption is a consumer

Which has been paid or partly paid or promised to be paid in future or under any deferred payment includes any person who buys such a good and services for his consumption and consideration is known as the consumer.

But the system or payment of deferred payment of such a person should not buy goods and services for resale or any commercial usage and purposes. 

For example, A shopkeeper person A buys shoes in large numbers say about 50, he will be a seller. Though he bought the shoes he didn’t buy them for his usage he has bought them for resale those shoes further. Therefore, the person who buys shoes from shopkeeper A will be the end consumer. He will be called a consumer and not the shopkeeper. 

Expression commercial purposes? 

The term commercial purposes don’t include when a person has bought any goods and services for his usage and consumption it is otherwise when ut is explicitly bought for his consumption and consideration to earn his livelihood or utilize self-employment. 

From where the goods and services are bought? 

According to the act of consumer protection, the provision includes any goods and services which are bought from online buyers as well offline buyers through electronic devices that will be included as a consumer. These also include teleshopping or direct selling or multi-level marketing.

Therefore, if any consumer has been cheated by the seller or has have received faulty goods or fraud has taken place then in such case a consumer can protect his rights under the consumer protection legislation. 

Rights of a consumer

  • Protection Against hazardous goods and services, that is which are harmful to life and property for every human. 
  • Right to be informed, information about quality quantity price of the goods
  • Access to the variety that is there should be options for the consumer to buy. Good and services. There should be no unfair practices taken place or No monopoly of any seller should take place. The goods and services should be sold at competitive prices. 
  • Right of redressal against unfair trade practices, if any consumer observes that any unfair trade practices are been practiced by anyone in the market then can approach the authorities concerned for the redressal.

CONCLUSION

Under this article we have discussed, who is a consumer under CPA,2019. A consumer is a person who buys any goods or services for their consumption and does not resell them further. It has been discussed in detail above. And the rights of consumers under the consumer protection act.
