Recent judgments on Freedom of Press

Freedom of press is related to freedom of speech and expression. A foundation was laid by freedom of press and speech that good and perfect functioning of government is necessary and is also possible without public education and political discussion. This was printed in Cross Road, an English journal which was published but later banned by government of Madras as it was held violative. Freedom of press has been upheld by court and its laws have been invalidated. There are many cases where our legislature has suppressed freedom of press. Under 19(2), the daily newspaper fixed a price where they could publish the news and pages and it was held violative of freedom of press. The freedom of press is very much important in our democracy and it acts as a watchdog on all three organs of our government- legislature, executive and judiciary. Besides, freedom of press is subject to many restrictions under article 19(2) listed are public order, decency, contempt of court and sovereignty and security.

Freedom of press though enjoyed by citizens but it faces a lot of difficulties. Taking a reference from Tehelka case, the journalists of the case faced so much harrasment because they exposed their scam of defence ministry and central government ministers. The journalists were given threats and assaulted many times. Despite of all these, our freedom of press has achieved a huge success.

In prof Sabharwal’s case, Proff Sabharwal was killed by ABVP activists and there was a lot of evidence for that. But still the case was closed by the police officials and they termed it as “Open and Shut Case”. As observed by the privy council, freedom of press has no statutory guarantee. Freedom of press has a lot of achievements. Journalism which was only focused press now contains electronic media. Everything starting from writing to printing is included. Thus, press is a great power and acts as a fourth pillar of democracy in the words of “Mahatma Gandhi”. It has a very huge role in delivering justice and providing public welfare. The national commission has reviewed the constitutional works and recommended that article 19(1) should also include freedom of press along with speech and expression.
